20 Job Categories Eligible for Staffing Services in Vietnam

What is Staffing?

Staffing refers to the arrangement where a worker signs a labor contract with a licensed Staffing Services company but works under the supervision of a third-party employer (the “client business”). The worker remains legally employed by the subleasing provider but follows the client’s daily operational directives.

Relationship Structure:

  • Subleasing Provider: Holds a government-issued license, signs labor contracts, and assumes legal responsibility for employees.
  • Client Business: Enterprises, organizations, or individuals who temporarily need workers.
  • Worker: Legally employed by the subleasing provider but works under the client’s direction.

Legal Basis for Staffing Services in Vietnam

This model is governed by:

  • Article 52, Clause 1 – Labor Code 2019
  • Articles 12, 13, 14 – Decree 145/2020/NĐ-CP

These regulations define the conditions, rights, and responsibilities of all three parties involved: the subleasing provider, the client business, and the worker.
